Mrs Justice Proudman has given her judgment in Bourne & 101 Ors v The Charit-Email Technology Partnership LLP [2009] EWHC 1901 (Ch). The case concerns a Companies Court application under s. 130(2) of the Insolvency Act 1986 for permission to commence proceedings against the respondent, a limited liability partnership in liquidation.

New January 2010 updates in the ODNB that are pertinent to insolvency law and legal history generally

The January 2010 update of the Oxford Dictionary of National Biography (ODNB ) contains a number of additions that are of interest to those interested in the history of insolvency law and policy and legal history generally. Among the updates feature four judges who handed down some important decisions in the area. There are also new entries for the Lord Rawlinson QC, the Lord Mishcon QC and Professor Kurt Lipstein QC. The Lord Acker ( Ackner , Desmond James Conrad, Baron Ackner (1920–2006), judge) receives a thorough biographical examination by Michael Beloff QC. Lord Ackner's early performance at University may provide some solace to struggling undergraduates. Beloff notes, " His unremarkable 2:2 in his tripos gave no hint of his future success...In 1945 he was called to the bar by the Middle Temple, with a third in his bar finals." Lord Ackner was on the panel in Stein v Blake (No.1) [1996] A.C. 243 ; [1995] 2 W.L.R. 710 ; [1995] 2 All E.R. 961; [1995] B.C.C. 543

Press Release - "R3 supports MPs in launching Insolvency APPG to tackle growing debt concerns among constituents"

I recently put up a post on the new All-Party Parliamentary Group on insolvency. R3 have now issued a press statement on the group. This is particularly noteworthy as it names the MPs and peers who are involved in the group. The R3 notice states: "The current recession has brought to the fore concerns about insolvency and the possible impact on individuals and businesses in financial trouble. MPs’ experiences in constituency surgeries has proved to be the catalyst in the setting up of a new All - Party Parliamentary Group on Insolvency whose aim is to facilitate MPs understanding of debt issues to support their work with constituents. The Group, which is being supported by insolvency industry trade body R3, is being chaired by Natascha Engel MP (North East Derbyshire) who says; “One of the really worrying things is that the word ‘insolvency’ terrifies people to such an extent that it puts them in denial. Insolvency is not normally an issue which gives rise to much mirth. This blog entry is designed to rebut that perception. Here follow a number of insolvency themed jokes which I have stolen from Mr Bob Monkhouse's legendary joke book and Tommy Cooper (pictured).
