Insolvency in the News and Lehman Brothers Special Financing Inc v Carlton Communications Ltd [2011] EWHC 718 (Ch) (28 March 2011)

There are a couple of interesting insolvency items in the news. The Irish Times is reporting - 'Rise expected in developers using UK bankruptcy laws.' The article notes that the, "decision to go bankrupt in Britain is now expected to become a major trend..." The article continues with a debtor noting, "“My feeling is why wait 10 to 15 years to go through this process when I can be in and out of bankruptcy in Britain in 12 months? Okay, I’ll be a bankrupt but I can get on with my life then.” Meanwhile, Mr Justice Briggs (pictured) has handed down his judgment in Lehman Brothers Special Financing Inc v Carlton Communications Ltd [2011] EWHC 718 (Ch) (28 March 2011). The case concerns issues around the famous anti-deprivation principle.
